TERMS AND CONDITIONS

Please note that all our products are subject to the terms and conditions listed below: 

1. Who we are and the platform services offered 

1.1 In these terms and conditions, 'we' 'us' and 'our' refers to Go Digital Technologies (Pty) Ltd. In collaboration with one81 (Pty) Ltd and selected partners these Terms and Conditions ("Terms") provide the GoThrive digital platform ("the Platform") in support of Go Digital Technologies’ community empowerment initiative. The words “you”" or “your” refers to a client or a non-client. Your access to and use of all the information on this platform including your purchase of our service(s) and/or products is provided subject to the following terms and conditions. 

1.2.  We empower communities through technology, enabling seamless access to essential services. 

1.3 We reserve the right to amend this notice at any time and your use of the website following any amendments will represent your agreement to be bound by these terms and conditions as amended. We therefore recommend that each time you access our platform you read these terms and conditions. 

1.4 The materials on our platform are provided by us as a service to you and may be used for informational purposes only. 

 

2. The legal terms of our relationship with you 

2.1. If you decide to use our Platform, we need you to understand what our obligations are to you and what your obligations are to us. We call this document our terms of service (“our terms”).  These Terms and Conditions ("Terms") govern your access to and use of our Platform. It is important that you read this document carefully and understand what it says. 

2.2. Our terms will apply when you register to use any of our Digital Platforms. By registering on any of the Digital Platforms, you agree to accept our terms. 

2.3. As we will hold some sensitive personal information about you, we need you to be satisfied with how we will deal with your information. It is important that you are not only happy with our terms, but that you are also happy with how we hold or process your personal information. We explain how we hold or process your information in Section 5 below. When you accept these Terms, you acknowledge that you understand and agree to how we process your personal information in accordance with the South African Protection of Personal Information Act, 4 of 2013 ("POPIA"). 

2.4. Our Terms may change from time to time. When we change them, the changes will be made on our Platform. Please ensure that you regularly read our Terms. Although we do not promise to do so, we may give you notice of any changes we think are important. 


 3. Purpose of the Service 

Our Platform offers: 

  • - Wellness education and lifestyle content 
  • - Learning and skills development courses ("GoLearn") 
  • - Job opportunity matching and employment services ("GoEarn") 

By using this Platform and joining our Club - The “GoClub”, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Notice. 

When you join the GoClub, — you’re joining a tailored digital ecosystem designed especially for you. Your preferences help us make your experience unique — and by consenting, you allow us to maximise your experience and serve you with content that matters most to you.u.  Our mission is to harness technology that strengthens communities and simplifies how people access vital services. 


4. Access to the Service 

4.1. To use our Platform, you must: 

  • - Be 16 years or older, or use the service under parental/legal guardian supervision 
  • - Have access to an internet-connected device 
  • - Provide accurate and complete registration information 

You must be at least 16 years of age to use the Service. By agreeing to these Terms, you represent and warrant to us that: (a) you are at least 16 years of age; (b) you have not previously been suspended or removed from the Service; and (c) your registration and your use of the Service is in compliance with all applicable laws and regulations. If you are using the Service on behalf of an entity, organisation, or company, you represent and warrant that you have the authority to bind that organisation to these Terms and you agree to be bound by these Terms on behalf of that organisation. 

4.2 Go Digital is committed to protecting the privacy of children. You should be aware that the Service is not intended or designed to attract children under the age of 15. Go Digital does not collect personally identifiable information from any person we know is a child under the age of 15.  

4.3 The Platform may be accessed: 

  • - Directly by individuals 
  • - Through technical partners, like mobile network operators 
  • - Via employer wellness programmes as part of employee benefits 
  • - Through community organisations and partners 

4.4 You are permitted to download a copy of the information from our platform not for commercial use but for personal use only, provided that you do not delete, change, amend, dissemble or alter any of our copyright symbols, logos, trademarks. 

 4.5 The information provided on our platform is based on information supplied by us (unless otherwise specified). You are not permitted to copy, reproduce, republish or distribute or display any of our information as set out on our website without our prior written consent. 

 4.6 While every endeavour has been made to supply accurate information, errors and omissions may occur. Accordingly, we do not accept any liability for any loss or damage which may directly or indirectly result from any advice, opinion, information, representation, or omission, whether negligent or otherwise, contained on our website or any omission or commission of actions which may take place based upon information provided, be said information be correct or incorrect. 

 4.7 Changes or updates to the platform may occur without notice. No information on the platform, which is either added or removed, shall affect any contract for products or services you may already have with us. 

 

5. Ownership of materials and information 

We own all the materials, and information may not be copied, reproduced, modified, published, uploaded, posted, transmitted, or distributed in any way, without our prior written consent. Except as expressly provided herein, we and our suppliers do not grant any express or implied right(s) to you under any patents, copyrights, trademarks, or trade secret information. 

 

6. Intellectual property 

The platform is owned by one81 Pty Ltd and operated by us. The trademarks, copyright and other intellectual property rights in the materials and/or information on the platform are owned by or were licensed to use the material and/or information. 

No material and/or information on the platform may be reproduced, republished, uploaded, posted, transmitted, stored (including on any other website or other electronic form) or distributed in any way, without our prior written consent, except that you may make one copy (printed or downloaded) of the extracts from the website for your own personal or domestic use, provided you keep all accompanying copyright and other proprietary notices intact. 

Modification of any of the materials and/or information or use of the materials for any other purpose other than for personal or domestic use, will be in violation of our copyright and other intellectual proprietary rights. 

 

7. How we use your personal information 

7.1. To allow us to provide our services to you, you will need to register and create an account on our Platform. For the purposes of administering your account, we will communicate with you on the email address or mobile number you used to register with us.  

7.2. All information that we collect from you will be processed in accordance with POPIA. By registering with us, you consent to us collecting and processing your personal information in the ways described in these Terms and our Privacy Policy. We collect and process the following types of personal data: 

  • - Identity Data: Full name, ID number, date of birth 
  • - Contact Data: Mobile number, email address 
  • - Demographic Data: Age group, gender, geographic location 
  • - Preference Data: Interests, habits, purchasing behaviour, responses to surveys, offers or rewards 

We may share data with parties within our ecosystem for the purposes of tracking performance on internal and external initiatives, as well as for research purposes. The data relates to your:  

  • - User profile  
  • - System Usage and engagement  
  • - Anonymised User demographics 

We may generate anonymised or aggregated insights from your data to help us and our partners improve services, understand community needs, and support research. These insights will never identify you personally We use this information for your benefit as follows: 

  • - Personalising your content and communications 
  • - Managing competitions, prize draws, and loyalty programmes 
  • - Providing tailored advertising and offers 
  • - Generating anonymised insights and behavioural research 
  • - Providing aggregated or targeted insights to paying research or commercial partners 
  • - Sharing community updates and mall-related information 

7.3. We will ensure that your information is kept confidential and secure using industry standard security methods.  

7.4. You have various rights under POPIA, including the right to access, correct, and request deletion of your personal information.  


8. Consent to Data Sharing and Commercial Use 

By registering, you explicitly consent to the sharing of your personal (and where applicable, sensitive) information with: 

  • - Mall owners or property managers affiliated with GDT 
  • - Strategic partners and service providers supporting CRM, research, or marketing operations 
  • - Paying research clients or brands who commission community or customer insight reports for your and/ or community benefit. 
  • - Local social investment or development programmes affiliated with the mall 

All third-party recipients will be contractually bound to use your data only for the agreed purposes, in line with POPIA. 

Note: No personal information will be sold for spamming or unrelated marketing. All data sales or sharing are for value-added purposes like personalised offers, community upliftment programmes, or market research. 


9. Conduct and Safety 

9.1. You agree not to use the Platform to: 

  • - Post unlawful, harmful, threatening, or abusive content 
  • - Infringe on any intellectual property rights 
  • - Upload viruses or malicious code 
  • - Harass or bully other users 
  • - Post unauthorised commercial communications 

9.2 We may suspend or terminate your access to the Platform at any time for misuse, breach of these Terms. 

 

10. Accuracy and Consequences of False Information 

By submitting your details, you confirm that all information is true, accurate, and current

  1. Important: If false or misleading information is provided during registration or engagement, you may be disqualified from loyalty rewards, competitions, community initiatives or any products purchased via this channel.  
  2. Lawful Basis for Processing 

We process your personal data under the following lawful bases: 

  • - Consent: You voluntarily provide your information when joining the Club or using the Wi-Fi 
  • - Legitimate Interests: To improve service delivery, conduct analytics, help us understand your priorities and enhance your mall and shopper experience 
  • - Legal Obligation: For regulatory compliance or fraud prevention 

 

11. Security and Storage of Data 

Your data is stored securely using a combination of: 

  • - Encrypted databases 
  • - Secure data centres 
  • - Role-based access controls 
  • - Firewall and intrusion detection tools 

The information you provide when you register may be stored on or processed by third-party providers in jurisdictions located outside South Africa on servers located outside South Africa. In such cases, we ensure equivalent protection through legal safeguards such as standard contractual clauses or compliance with applicable privacy frameworks

 

12. Automated Profiling & Decision-Making 

We may use AI or automation to: 

  • - Segment audiences by interest or behaviour 
  • - Serve tailored marketing content or ads 
  • - Recommend products or services 

You may request human review of any automated decision that significantly affects you. 

 

13. Your Rights Under POPIA 

You may: 

  • - Access the personal data we hold about you 
  • - Correct or update inaccurate information 
  • - Request deletion of data (subject to legal or operational requirements) 
  • - Object to certain processing activities 
  • - Withdraw your consent at any time

14. Retention Period 

We retain your personal data: 

  • - For a period of 5 years after your last log in to any GDT system, or 
  • - As required to fulfil the purpose of collection, or 
  • - As required by law, or 
  • - Until you tell us you would like it deleted 

Thereafter, your data will be securely deleted or anonymised. 

 

15. Breach Notification 

In the unlikely event of a data breach involving your personal information: 

  • - We will notify the Information Regulator and affected users within a reasonable timeframe 
  • - We will provide clear instructions on steps to mitigate risk.  
  • - In addition, any affected parties shall be advised of any further pertinent information such as actions taken, parties affected, the remedial plan etc. 

 

16. Marketing Communications and Opt-Out 

By joining the GoClub, you may choose to receive promotional messages and personalised campaigns from Go Digital and its partners. You can update your preferences or opt out at any time. 

 

17. Site uptime 

We've taken all reasonable steps to ensure the uptime of our platform. There will be downtime from time to time, due to maintenance and upgrade issues. We won't be liable if the platform becomes unavailable for any reason. Where possible we'll provide warnings for planned downtime. 

 

18. Links 

The sites linked to this platform are not under our control. We are not responsible for, and make no representations, warranties or conditions concerning, the contents of any linked site or any links contained in a linked site. We provide links to you only as a convenience, and the inclusion of any link does not imply endorsement, investigation or verification by us of the linked site. You are not allowed to publish any false information about us. You are not allowed to place a link on a website that's not your property. 

 

19. Limitation of Liability 

We provide the Platform and the material and/or information contained on an ‘as is’ and ‘as available’ basis. While we take reasonable precautions, we cannot guarantee uninterrupted service. Whilst we use our reasonable efforts to ensure that the material and/or information on the platform is up to date and accurate, we do not warrant or make any representations as to the accuracy, completeness or reliability of such materials and/or information on this website. 

Upon entering your personal details on this platform, you consent to us processing your information in accordance with our privacy policy.  

Although we take all due care in ensuring that our platform is free of any virus, worm, trojan horse and/or malware, you agree that we will not be responsible for any damage to your computer system which arises in connection with your use of our platform or any linked website. 

Nothing in these Terms excludes or limits liability where such exclusion is prohibited under the Consumer Protection Act or other applicable law. To the fullest extent permitted by law, Go Digital, its Partners, and one81 will not be liable for any damage (direct, incidentally, special, consequential, indirect or punitive) that may result from your use of our platform. You agree that should we be held responsible for any damage or loss, whether direct or indirect, our total liability to you for all damages, losses and costs under whatever causes of action (whether in contract, delict or otherwise) will not exceed the amount paid by you, if any, for accessing the platform 

 

20. Indemnity 

By accessing and/or engaging with our platform, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our platform. 

 

21. Jurisdiction 

These terms and conditions are governed by and will be construed in accordance with the laws of the Republic of South Africa, and you submit to the jurisdiction of the courts of South Africa. 

 

If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity. If necessary, the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect. 

 

22. Other 

These terms and conditions represent the entire agreement between the parties and shall not be modified except by an agreement in writing signed by us. 

By registering on our platform, you consent to receive marketing communication from us. You may unsubscribe from receiving such communication at any point in time by using the link set out in the relevant email or form. 

 

23. Changes to These Terms 

We reserve the right to update or amend these Terms at any time. The latest version will be published on our website or login screen. Continued use of the Platform implies acceptance of the most recent version.
